Alan
Alan Saler was able to settle a contentious religious
discrimination case, when neither I nor my client thought
there was any chance of resolving it. I was impressed with
Mr. Saler's approach and my client and I were very happy
with the result. Since the mediation, I have been
spreading the word about him throughout my firm’s
offices. |

Actions
speak louder than words. In just the last 6 months, Alan
has settled three very difficult liability cases for $2
million (Plaintiff's car crashes into alleged stationary
trash truck), $2.7 million (product liability), and
$600,000 (construction site fall.) His follow through is
unbeatable and gets cases (even the toughest) settled. His
thoroughness in understanding the facts, law and real
world risks for both sides makes him an advocate for the
process rather than one particular side.

Mr.
Saler did an excellent job. He was courteous, respectful
of one another's positions and sought to isolate the key
issues that would determine whether the case would or
would not settle. He also approached the task with
determination and a positive commitment from the outset
that the parties would come to a reasonable resolution for
all concerned. |

I
enjoyed mediating a very complex medical negligence case
with Alan Saler. The case involved pathology misread and
prognostic survivability for Melanoma. Mr. Saler was able,
with considerable effort and tenacity, to prevent the
mediation from disintegrating and was able to settle the
case. He was conversant with the briefs and exhibits and
had an excellent command of the facts. I would highly
recommend his services and plan to use him in the future.

Without a doubt, highly recommended.

I have
sent an e-mail to the attorneys in our Orange County
office with information about your services and my
personal observations of how you handled our mediation. I
was most impressed with your thorough preparation. It was
immediately clear that you had spent a significant amount
of time carefully considering the materials we provided to
you beforehand so that you had mastered the issues as well
as the strengths and weaknesses of each side before we
arrived. I rarely see this kind of preparation by
mediators. Your preparation and direct approach allowed us
to focus on those things necessary to resolve this case. I
look forward to working with you again.

Alan
Saler mediated a very high dollar value, harassment,
discrimination, wage and hour employment case. There were
numerous parties and counsel, partly because of complex
insurance coverage issues. He obviously read the submitted
materials carefully before the mediation. It took two
sessions and a lot of tenacity on Alan's part to recognize
the various competing interests and deal with them
effectively. I'm quite pleased with his work and highly
recommend him to other employment attorneys. |

I
was recently fortunate to have another attorney recommend
Alan Saler to mediate a complex, multi-party insurance
broker and legal malpractice action. Mr. Saler was
extremely well prepared and was able to fairly and
effectively analyze and communicate the strengths and
weaknesses of the parties respective positions. Without
his tact and determination the matter would certainly not
have settled. Although the case did not resolve during the
lengthy mediation session, Mr. Saler tenaciously
communicated with counsel countless times during the next
several weeks. His effort was instrumental in achieving a
comprehensive settlement. I highly recommend him.

Thank
you again for your assistance in resolving our matter,
which required a considerable amount of skill on your part
to bring the parties with their widely divergent interests
together to reach a settlement. These interests included
those of the plaintiff, who sustained a serious back
injury requiring surgery and life time medical treatment;
a plaintiff-in-intervention who had expended more than
$150,000 for medical expenses and salary in lieu of
temporary disability; the defendant whose insurance policy
was canceled before the loss giving rise to plaintiff's
injuries and who was threatening to file bankruptcy if the
matter could not be settled so as to avoid a jury trial;
an insurance broker as a cross-defendant as to whom it was
alleged that he had wrongfully appropriated payments made
by the defendant for their liability insurance and failed
to keep the insurance policy in force and effect; and,
finally, the E & 0 carrier for the insurance broker
which contended that it had a very strong claim for
rescission of the insurance policy based on the broker's
fraud in completing the application and his other apparent
misconduct. You were able to navigate the shoals of the
controversy in a way which led to a settlement which
avoided the bankruptcy proceedings and a complicated
trial, whether in the Superior Court or in the bankruptcy
arena. |

If
the late singer, James Brown, was "the hardest
workin' man in show business," then Alan Saler is the
hardest workin' mediator. Mr. Saler just finished
assisting in the settlement of an injury case. Even though
the formal mediation session was months ago, he stayed in
touch, kept prodding the other side, and ultimately was
able to bring the parties to a resolution today (the
morning of the first day of trial.) I highly recommend
him.

Mr.
Saler was very effective in mediating our Wage and Hour
case. It was a pleasure working with him. It was obvious
that he had carefully prepared by thoroughly reading the
mediation briefs. He came to the mediation with a good
command of the legal and factual issues. He did not shy
away from expressing his opinion of the relative strengths
and weaknesses of the parties' claims and defenses and was
very pragmatic in his approach. When the case did not
resolve during the mediation session, he continued to
diligently speak with counsel by telephone until he
achieved a settlement. |

Mr.
Saler recently mediated a high value, medically complex
personal injury case, in which the parties started the day
far apart. What he accomplished was phenomenal. We began
the session early in the morning because the Final Status
Conference was at 1:30 p.m. Trial was the following day.
Just before noon, Mr. Saler called the court clerk and
obtained an extension of time to 3:00 p.m. Since
negotiations were ongoing at 2:00 p.m., and we had to go
to court, he followed us in his car to the downtown
courthouse. When he arrived in the courtroom, he asked the
judge for more time. He continued to mediate the case in
the jury room and he settled it a few minutes before 5:00
p.m. I have never seen any mediator show such commitment
and dedication. I have to say that he is the best mediator
with whom I have ever had the pleasure of working.

Saler is a superb mediator. He recently concluded a
mediation that lasted more than six months. He was
professionally tenacious in helping to resolve a serious
hip fracture case, resulting from a trip and fall at a
commercial complex. He started his coaxing before, during
and after the initial mediation session. He was persistent
and dedicated to a fair resolution of the case for all
parties.

It was a
pleasure to mediate our case before Mr. Saler. It was
quickly apparent he had read all of the briefs and the
numerous exhibits. He immediately focused on the issues in
dispute. I appreciated his diplomacy when discussing the
strengths and weaknesses of our case in front of my
client. There was a great deal of animosity between my
client and the defendant, his former employer. After
several hours, Mr. Saler was able to get the parties to a
point where the case settled. After the mediation, my
client expressed to me how much he appreciated Mr. Saler's
efforts. This matter would not have resolved with a less
skillful mediator. |

Alan
Saler recently mediated a residential real estate matter
dispute involving an alleged failure to disclose. I
represented the realtor and the listing agent. I was
extremely impressed with his handling of the process, in
part, because he appreciated the need to set aside his ego
despite the fact that at the time I was usurping his role.
He never lost sight of the singular goal of mediation,
which is to resolve, what in this case, was a very
emotionally charged dispute. |

Many
thanks for your near-heroic efforts in assisting us in
settling our recent retaliatory termination case. I was
most impressed with your extreme attention to detail, as
witnessed by the typed outlines of facts, evidence and
issues you prepared in advance of the mediation. Your
'style' was such that my client (the plaintiff) felt very
comfortable sharing his views with you and telling his
story. I very much appreciated your frequent E-mail
messages and telephone calls during the several weeks
following the mediation. I am convinced that your thorough
knowledge of the case greatly assisted both sides in
realistically assessing our respective positions and
arriving at a mutually agreeable settlement. I will not
hesitate to use you in the future! Many thanks for
assisting us in reaching a fair settlement and avoiding
two or three weeks in jury trial. |

Mr.
Saler recently mediated a plaintiff's case for me. It was
not an emotional or particularly contentious case, except
that the defense counsel, who is most able and

in the face of reason, experience and logic on both sides
nearly impossible. Mr. Saler performed the nearly
impossible. The case settled. |

Mr.
Saler presided over a difficult case, in which the parties
had lost trust in one another and persuaded them to
bargain in good faith and ultimately resolve the dispute.
He showed my clients considerable understanding but was
also forceful enough to help them appreciate the risks of
continuing to litigate. When we drew the proverbial line
in the sand and made our final demand, he was able to
persuade the other side to pay the amount we were seeking. |
